ADMISSIBILITY OF EVIDENCE OBTAINED AS RESULT OF BREACH OF DUTY TO TAKE SUSPECT TO POLICE STATION AS SOON AS PRACTICABLE AFTER ARREST

A breach of the duty under the Police and Criminal Evidence Act 1984 s.30 to take a suspect to a police station as soon as practicable after arrest would not give rise to a presumption that evidence obtained during the period of delay should be excluded; whether such evidence should be excluded would depend on the facts of the case.
