ADJOURNING TRIAL WITH VIEW TO MAKING HOSPITAL OR GUARDIANSHIP ORDER

In a case of alleged insanity at the time of an offence, a magistrates’ court had the power to abstain from either convicting or acquitting and instead to make a hospital or guardianship order under the Mental Health Act 1983 s.37(1), provided that the conditions for making such an order were met.
