ADMISSIBILITY OF TEXT MESSAGE EVIDENCE TO SHOW NATURE OF CO-DEFENDANT’S RELATIONSHIP

A judge had been entitled to admit text message evidence under the Criminal Justice Act 2003 s.101(1)(d) against a defendant in his trial for conspiracy to supply a Class A drug as it demonstrated the nature of his relationship with a co-defendant, who had admitted significant involvement in drug activity, which in turn demonstrated his propensity to commit the offence.
