ADMISSIBILITY OF MEDICAL EVIDENCE TO INDICATE VULNERABLE PERSONALITY

[2010] EWCA Crim 3212 [2010] EWCA Crim 3212

Evidence of an emergency call made by an offender was admissible as statements made in the call did not suggest that they were being made by a deluded person. The Police and Criminal Evidence Act 1984 s.77 did not apply so as to exclude the evidence since the medical evidence did not establish that the offender was mentally handicapped and the statements in the emergency call did not amount to a confession.
