ACTIVATION OF SUSPENDED SENTENCE AFTER 20 MONTHS

A magistrates’ court had erred in its purported use of its powers under the Magistrates’ Courts Act 1980 s.142 by activating a suspended sentence some 20 months after the passing of the sentence where it had taken into account matters that were not relevant to the sentence when it was originally imposed.
