ACTION FOR TRESPASS FOR EXCESSIVE SEARCH AND SEIZURE

In proceedings for damages for trespass to property and goods, in which the triable issue concerned entitlement to damages if, in the execution of a search warrant, the police had seized a computer known to contain legal professional privileged material, it was not appropriate to grant broad interlocutory injunctive relief restraining the police from accessing or using any of the large volume of seized material until trial or further order.
