ABILITY TO RAISE PREVIOUSLY DETERMINED ISSUES IN APPLICATION TO VARY CONFISCATION ORDER

A defendant who had applied under the Proceeds of Crime Act 2002 s.23 to vary a confiscation order was not entitled in that application to challenge an earlier finding as to his realisable assets. The Crown Court did not have the jurisdiction to go behind the original confiscation order.
